NO PURCHASE NECESSARY. 
 

The Grand Prize is a 2-day/1-night camping experience for two (2) to take place on Saturday, February 3, 2024 and Sunday, February 4, 2024 at Mt Seymour in North Vancouver, Canada; Travel to Mt Seymour in North Vancouver, Canada NOT included.
 

1. Eligibility

The North Face MTN Mix Sweepstakes- Canada ("Sweepstakes" or “Promotion”) is open only to legal residents of the province of British Columbia, Canada who are at least 19 (nineteen) years of age or older. If you also have a 2023/2024 season pass to Mt Seymour resort (as per the business records of Mt Seymour Resorts Ltd.), you will be eligible for a special random drawing which is available only to eligible persons who are XPLR Pass members AND 2023/2024 season pass holders. 
 

The following persons are NOT eligible: 
 

• (a) Employees, officers, directors and independent contractors of The North Face, a division of VF Outdoor, LLC ("Sponsor"), Probability LLC ("Administrator"), Mt Seymour Resorts Ltd. ("Mt Seymour” or “Prize Provider"), AnyRoad Inc., Dizzle Entertainment Inc., their respective parent companies, divisions, subsidiaries and affiliated companies;
• (b) the immediate families (defined as parent, child, sibling, spouse), regardless of where they live, of such employees/officers/directors/independent contractors; 
• (c) the members of the same household, whether related or not, of such employees/officers/directors/independent contractors; 
• (d) individuals whose membership in XPLR Pass was terminated by Sponsor due to engaging in prohibited conduct;
• (e) individuals who were issued a 2023/2024 season pass by Mt Seymour which was subsequently terminated by Mt Seymour for any reason; and
• (f) individuals who are otherwise not eligible to participate in XPLR Pass (including unauthorized resellers of The North Face products). 

Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s/Administrator’s decisions, which are final and binding in all matters related to the Sweepstakes. Winning a prize is contingent upon fulfilling all requirements set forth herein. 

Internet access is required to participate.

4. Sweepstakes Schedule

The Sweepstakes begins on or around 12:00 am Pacific Time (“PT”) on Friday, December 15, 2023 and ends at 11:59 pm PT on Saturday, January 6, 2024 ("Promotion Period"). AnyRoad Inc.’s computer is the official clock for this Promotion.
 

5. How to Enter

To enter the Sweepstakes, during the Promotion Period, navigate the Internet to   https://www.thenorthface.com/en-ca/events#id=canada-mtn-mix-sweepstakes (the “Website”). On the Website, you must complete the entry form by providing your first name, last name, e-mail address, postal code, date of birth (optional) mobile phone number, confirm if you are an existing XPLR Pass Member and if you are a 2023-2024 season pass holder to Mt Seymour.

You may be asked to consent to receive promotional and reminder e-mails from Sponsor. Consenting to receive promotional and/or reminder e-mails is optional, does not have to be agreed to in order to join XPLR Pass or be eligible to participate in the Sweepstakes and does not improve your chances of winning. In the event you do consent to receive these e-mails, the use of the e-mail address provided shall be subject to the privacy policy of Sponsor and you may opt out of receiving these e-mails at any time.

To submit your entry ("Entry") click the "Submit" button on the Website. Proof of inputting information at the Website is not considered proof of delivery to or receipt by Sponsor or Administrator. Receipt of Entry may be acknowledged but such acknowledgment does not constitute a representation by Sponsor or Administrator as to eligibility of entry and is not otherwise binding upon Sponsor or Administrator.

All Entries must be received no later than 11:59 p.m. PT on January 6, 2024. 

Message and data rates may apply to use of mobile device for Entry. Be sure to check your wireless carrier’s pricing plan before participating. Wireless internet access may not be available in all areas.
 

6. Additional Restrictions on Entry

Limit of one (1) Entry per person. Multiple Entries received from any person in violation of the preceding limitation will void all such Entries and may result in revocation of membership in XPLR Pass. Entries generated by a script, macro, or other automated means or by any means that subverts the entry process will be disqualified (and may result in revocation of XPLR Pass membership. Entries that are late, lost, incomplete, garbled, illegible, delayed, damaged, corrupted, jumbled, misdirected, improperly recorded (or not recorded at all) or unintelligible for any reason, including, but not limited to, mobile device or network malfunction or congestion, are void and will not be accepted.
  

7. Random Drawing and Odds

Two (2) winners will be randomly selected on or about January 8, 2024 by Administrator at the address set forth above or another location of Sponsor’s choosing. There will be two (2) separate and distinct random drawings. Entries from one [1] random drawing will not be retained for the other random drawing. One (1) winner will be selected in a random drawing from all eligible entries received from those who are 2023/2024 Mt Seymour season pass holders (in addition to being XPLR Pass members) and one (1) winner will be selected in a random drawing from all eligible entries received from those who are XPLR Pass members but not 2023/2024 Mt Seymour season pass holders. Administrator’s decisions are final and binding on all matters related to the Sweepstakes.

Odds of winning depend on the number of eligible Entries received for the applicable random drawing.
 

8. Winner Notification & Verification

Each potential Grand Prize Winner will be contacted by telephone on or about January 8, 2024. To remain eligible for Sweepstakes, the potential winner must still be a member of XPLR Pass at time of winner notification; and, as applicable, the potential winner must also still hold a 2023/2024 Mt Seymour season pass at time of winner notification. If a potential Winner does not answer the telephone call during Administrator’s initial (and perhaps only) attempt or, return the telephone call within twenty-four (24) hours thereafter, potential Winner will be disqualified without compensation of any kind (for the avoidance of doubt, a message may not be left if potential Winner cannot be reached) and an alternate potential winner may be selected and contacted, time permitting. Selected entrants must first correctly answer a time-based mathematical skill-testing question without assistance of any kind, to be implemented by Administrator, as a condition to being considered a winner. Once potential Winner’s eligibility, interest and availability have been preliminarily confirmed via telephone, potential Winners will be required to sign and return, within seventy-two (72) hours of notification (or such shorter time period as indicated thereon), an Affidavit of Eligibility, Release and Indemnification, a Publicity Release where allowed by law and a Guest Release (collectively, “Prize Claim Documents”). The potential winner who is an existing Mt Seymour season pass holder must also provide the 14-digit Mt Seymour pass ID number from their current and valid 2023-2024 season pass for verification. If the Prize Claim Documents (other than Guest Release)† are not returned to Administrator within the specified time period, or if any prize notification or prize is returned as non-deliverable, or if a potential winner is found to be ineligible or otherwise not in compliance with these Official Rules, or declines the prize for any reason prior to award, prize may be forfeited and potential winner may be disqualified and an alternate winner may be selected from all remaining eligible Entries received during the Promotion Period for the applicable random drawing (time permitting). Prize Claim Documents are in addition to any waivers and releases that may be required by Mt Seymour in conjunction with Event attendance by Grand Prize winner and his/her/their guest.

†If all Prize Claim Documents other than Guest Release are timely returned, Grand Prize winner may receive the prize for him/her/themselves alone (i.e., without a guest) and no alternate prize or compensation will be awarded. 

In the event of any dispute concerning the identity of any Entrant, the Entry will be deemed submitted by the natural person who is the authorized holder of the transmitting e-mail account associated with The North Face XPLR Pass program. (And, to be eligible for the Mt Seymour season pass random drawing, such person must also be the authorized holder of a season pass.)  “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
 

9. Prizes and Approximate Retail Value ("ARV")

Grand Prize (Two [2] Winners): Each Grand Prize winner will receive a 2-day/1-night camping experience for two (2) at the top of Mt Seymour in North Vancouver, Canada scheduled to take place on Saturday, February 3, 2024 and Sunday, February 4, 2024 (“Event”). TRAVEL TO EVENT AT MT SEYMOUR IN NORTH VANCOUVER, CANADA IS NOT INCLUDED. Grand Prize winners and their guests must attend the Event on February 3-4, 2024. If a Grand Prize Winner cannot do so for any reason, Grand Prize will be forfeited without compensation of any kind, and an alternate winner may be selected as per Section 8. Winter camping experience includes: one (1) The North Face 4-seasons tent rental for two (2) people, two (2) The North Face -20 sleeping bags rentals, one (1) The North Face sleep pad for two (2) people rental, resort lift tickets for two (2) days of riding (February 3 – 4, 2024) (Only available if a winner or guest does not have a 2023-2024 season pass to Mt Seymour. If winner/guest has a 2023-2024 season pass to Mt Seymour, no substitute prize or compensation will be awarded in lieu of the resort lift tickets. The preceding includes but is not limited to winner of Mt Seymour season pass random drawing), dinner and breakfast at the campsite (excludes alcohol beverages; Sponsor disclaims any and all liability in conjunction with inability to accommodate dietary restrictions of winners and guests; additional restrictions may apply), and a The North Face product package for both winner and guest consisting of The North Face Summit Breithorn Down Jacket, The North Face Montana Ski Mitts, The North Face Basecamp Duffel (size L), and The North Face Salty Lined Beanie. Style, color and size of items (as applicable) subject to availability. The rental tent, sleeping bags and sleeping pad will be set up for the winners and their guests by a Sponsor representative upon arrival. For the avoidance of doubt, winners and their guests CANNOT bring these items home at the conclusion of the Event and will be responsible for any damage to tent/sleeping bags/sleeping pads beyond normal wear and tear from use as directed. ARV of each Grand Prize: $3,000.00 CAD. See additional restrictions/conditions below.

The Event is rain, snow or shine. If there is inclement weather on one or both days (as determined by Sponsor/Prize Provider in their sole discretion), winners will be able to stay indoors (instead of camping experience) but no additional compensation or substitute prize will be awarded. 

Ski and/or snowboard equipment (“Gear”) is not required as part of the Event or included as part of the Grand Prize. If a winner or guest would like to rent Gear, rentals will be at winners’ own expense and subject to availability and restrictions. A list of suggested items will be provided to Grand Prize winners prior to Event date. There will be a mandatory check-in on February 3, 2024 where Grand Prize winners and their guests will be required to complete a gear check for safety purposes and sign additional waivers provided by Sponsor and possibly Mt Seymour. If a Grand Prize Winner or their guest fails to pass the gear check, Grand Prize winner and/or their guest (as applicable) may not be allowed to participate in the Event (at Sponsor’s sole discretion). Grand Prize winners and their guests may have the opportunity to purchase items upon arrival, but all items are subject to availability and are not guaranteed by Sponsor. If Sponsor decides a Grand Prize winner or their guest is not prepared and therefore not allowed to participate in the Event, the Grand Prize will be forfeited without compensation of any kind.

Guest of Grand Prize Winner must be nineteen (19) years of age or older and must complete, sign and return a Liability Release, Publicity Release (where lawful) prior to Event. Should a Grand Prize Winner elect to participate in Event without a guest (or if guest fails to timely return signed Release, as discussed in Section 8), Grand Prize will be awarded in increments appropriate for a single person (that is, the Grand Prize Winner himself/herself/themselves) and no alternate prize or compensation will be awarded.

Grand Prize Winners and their guests understand and agree that outdoor winter camping and related activities (including but not limited to skiing/snowboarding) feature certain inherent risks/dangers which may result in injury/death even with the participation of an instructor/guide (as applicable) and following all appropriate safety protocols. WITHOUT LIMITATION, GRAND PRIZE WINNERS AND THEIR GUESTS EXPESSLY ACKNOWLEDGE THAT THE TEMPERATURE IN NORTH VANCOUVER, CANADA IN EARLY FEBRUARY IS TYPICALLY AROUND FREEZING (I.E., BELOW 0 DEGREES CELSIUS); AND, SUCH TEMPERATURES MAY FEEL EVEN COLDER DUE TO WIND AT TOP OF MT SEYMOUR. By way of example only, these risks include slips and falls caused by ice, uneven ground or otherwise; over-exertion; dehydration; hypothermia and exposure to pop-up storms or other sudden changes in weather conditions. YOU ARE ADVISED NOT TO ENTER THE SWEEPSTAKES IF YOU ARE NOT COMFORTABLE ACCEPTING SUCH RISKS SHOULD YOUR ENTRY BE SELECTED AND YOU ARE CONFIRMED AS A PRIZE WINNER.

A certain level of health and fitness is needed in order to participate in outdoor winter camping and related activities (including skiing/snowboarding). DO NOT ENTER THE SWEEPSTAKES IF YOU DO NOT REASONABLY BELIEVE THAT YOU ARE CAPABLE OF ENGAGING IN OUTDOOR WINTER CAMPING AND RELATED ACTIVITIES (INCLUDING BUT NOT LIMITED TO SKIING/SNOWBOARDING) SHOULD YOUR ENTRY BE SELECTED AND YOU ARE CONFIRMED AS A PRIZE WINNER. 

Grand Prize Winners and their guests must follow all instructions of the Sponsor as well as Prize Provider; and, Grand Prize Winners and their guests must comply with all policies of Mt Seymour. Failure to do so may result in forfeiture of the prize. Should a Grand Prize Winner and/or guest fail to adhere to any such instructions or engage in unruly, obnoxious, illegal, threatening, or otherwise inappropriate behavior (as determined by the Sponsor and/or Prize Provider in their sole discretion), the Sponsor reserves the right, without further notice or warning, to terminate the participation of Grand Prize Winner and/or their guest in the Event and/or take other actions as the Sponsor deems appropriate in their sole discretion without any liability or other obligation to Grand Prize Winner or their guest. (The preceding is in addition to any actions that may be taken by Prize Provider). Inappropriate behavior includes but is not limited to failing to abide by the policies of Prize Provider (e.g., skiing/snowboarding in a reckless manner) as well as the failure of a Grand Prize Winner or a guest to comply with governmental mandates, prize supplier or other third-party requirements designed to prevent the spread of COVID-19 (such as, mask-wearing, social distancing, completion of health questionnaire). 

Please be advised that Sponsor/Prize Provider's or other prize supplier’s policies, CDC guidelines, and the recommendations of health officials must be followed. Please note that any public location where people are present provides an inherent risk of exposure to COVID-19, and Sponsor cannot guarantee that any person will not be exposed during the Event; and, engaging in camping and related Event activities in close proximity with other persons may well amplify such health risks.

Limit one (1) prize per person, family or household. All details of Grand Prize will be determined in Sponsor's sole discretion. Sponsor reserves the right to substitute Grand Prize (or portion thereof; as applicable) with a similar prize (or prize element; as applicable) of comparable or greater value.  Certain activities comprising Event may be subject to availability and/or other restrictions. All other expenses, costs, or fees associated with the acceptance and/or use of Grand Prize are the sole responsibility of Winners; the preceding includes travel to and from North Vancouver, for Event as well as any desired life or other insurance in conjunction therewith. Grand Prize cannot be transferred by a Winner or redeemed for cash and is valid only for the Event experience as detailed above, with no substitution of Grand Prize by a Winner. Any images of venues and/or activities comprising Grand Prize in advertising are for illustrative purposes only and actual elements awarded as Grand Prize may differ from such images for various reasons; and Sponsor and Administrator (as well as Prize Provider) disclaim any and all liability in conjunction therewith. 

THE ONLY WARRANTY ON ANY PRIZE IS SPONSOR’S EXPRESS WARRANTY ON ITS OWN PRODUCTS WHICH IS LIMITED TO ITS TERMS; TO THE FULLEST EXTENT PERMITTED BY LAW, NO OTHER WARRANTY, REPRESENTATION OR GUARANTEE OF ANY KIND BY SPONSOR IS PROVIDED WITH ANY ELEMENT OF PRIZE. 
 

10. Entry Conditions and Release

By entering, each entrant releases and agrees to hold harmless Sponsor, Administrator, Mt Seymour, AnyRoad Inc., Dizzle Entertainment Inc., Meta Platforms, Inc., each of their respective parent companies, divisions, subsidiaries and affiliated companies, and all of their respective officers, directors, employees, agents, shareholders and representatives (collectively, the "Released Parties") from and against any and all claims, expenses and liability, including but not limited to negligence, damages, or injury of any kind to persons and property, including but not limited to invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, or death or personal injury arising out of or relating to a participant’s Entry, participation in the Promotion, acceptance or use or misuse of prize (if applicable); and (c) indemnify, defend and hold harmless the Released Parties from and against any and all claims, expenses, and liabilities (including reasonable attorneys’ fees) arising out of or relating to an entrant’s participation in the Promotion and/or entrant’s acceptance, use or misuse of prize (if applicable). Entrant agrees that, by entering the Promotion, (i) any and all disputes, claims, and causes of action arising out of or in connection with the Promotion, or the award of prize, shall be resolved individually without resort to any form of class action; (ii) any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Promotion (if any), but in no event attorney’s fees; and (iii) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim, punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for actual out-of-pocket expenses (if any) as well as waiving any right to equitable relief.
 

11. Publicity

Except where prohibited, acceptance of prize constitutes winner’s consent to Sponsor’s and its designees’ (including Prize Provider’s) use of winner’s name, likeness, photograph, voice, opinions and/or hometown for promotional purposes in any media, worldwide, without further payment or consideration or review/approval of any kind.
 

12. General Conditions

Sponsor reserves the right to cancel, suspend and/or modify the Sweepstakes or any part of it, if any fraud, technical failures, pandemic/epidemic, materials shortage, civil commotion, riot, strike, natural disaster of any kind or any other factor beyond Sponsor’s control impairs the integrity or proper functioning of the Sweepstakes, as determined by Sponsor/Administrator in its sole discretion. In such event, to the extent feasible, Sponsor shall endeavor to conduct the Sweepstakes and select the prize winner for each affected random drawing from among all eligible Entries received for such random drawing prior to and/or after the action taken by Sponsor (as appropriate) or otherwise in a manner which Sponsor/Administrator determines in its sole discretion is fair, appropriate and consistent with these Official Rules. Notification of such action by Sponsor will be posted on the Website. Sponsor reserves the right in its sole discretion to disqualify any individual Sponsor and/or Administrator find to be tampering with the procedure of participating in the Sweepstakes or the operation of the Sweepstakes, seeking to defraud Sponsor and/or Administrator as to membership in XPLR Pass and/or holding a 2023/2024 season pass to Mt Seymour or to be acting in violation of these Official Rules or in an unsportsmanlike, belligerent, anti-social or disruptive manner. Sponsor’s/Administrator’s failure to enforce any term of these Official Rules in a given circumstance shall not constitute a waiver of that provision.
 

13. Limitations of Liability

The Released Parties are not responsible for: (a) any incorrect or inaccurate information, whether caused by entrants, or programming associated with or used in the Promotion; (b) technical failures of any kind, including but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (c) unauthorized human intervention in any part of the Sweepstakes, including but not limited to use of the Website; (d) technical or human error, which may occur in the administration of the Sweepstakes or the processing of XPLR Pass memberships and/or Sweepstakes Entries; or (e) any injury or damage to persons or property, which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or receipt or use or misuse of prize (if applicable). 

If for any reason an entrant’s Entry is confirmed to have been erroneously deleted, lost or otherwise destroyed or corrupted, entrant’s sole remedy is another Entry in the Sweepstakes to the extent feasible; and, if not feasible, Released Parties shall not have any liability of any kind. No more than the stated number of prizes (i.e., two [2] prizes) will be awarded.
 

14. Disputes; Choice of Law

Except where prohibited, entrants agree that any and all disputes, claims, and causes of action arising out of or connected with this Sweepstakes, or the awarding of prizes/determination of prize winners, shall be resolved pursuant to the internal, substantive law of Ontario (i.e., without regard to choice of law/conflict of law rules of Ontario or of any other jurisdiction) in the courts in Ontario and you agree to the personal and exclusive jurisdiction of such courts as well as waiving any right of change of venue, inconvenient forum or the like.

If the preceding or any other provision of these Official Rules is determined by a court of competent jurisdiction to be invalid, illegal or unenforceable, it shall be replaced by a substitute provision that most closely approximates the original intent of Sponsor and is valid, legal and enforceable. The invalidity/illegality/unenforceability of a given provision shall not affect the remainder of these Official Rules.
 

15. Entrant’s Personal Information

By entering the Sweepstakes, you consent to the collection, use and disclosure of your personal information for the purpose of administering this Sweepstakes, including prize fulfillment (if applicable) and XPLR Pass Program membership. You further understand and agree that your personal information may be transmitted to the United States, which features more limited consumer protections and rights as to one’s personal information than Canada.  You are strongly advised to review The North Face’s privacy policy, accessible at https://www.thenorthface.com/en-ca/help/privacy) BEFORE entering the Sweepstakes (and, if applicable, joining XPLR Pass). 
 

16. Winners’ List

For the names of winners, mail a self-addressed, stamped envelope to: The North Face MTN MIX Winners- Canada, c/o Probability, PO Box 1559, Social Circle, GA 30025-1559. All such requests must be received by January 26, 2024.

• (b) Les membres de la famille proche (définis comme étant les parents, les enfants, les frères et sœurs, les conjoints), quel que soit leur lieu de résidence, de ces employés/dirigeants/administrateurs/entrepreneurs indépendants; 
• (c) Les membres du même foyer, qu’ils soient apparentés ou non, de ces employés/dirigeants/administrateurs/entrepreneurs indépendants; 
• (d) Les personnes dont le Commanditaire a résilié l’adhésion à XPLR Pass en raison d’une conduite interdite;
• (e) Les personnes à qui Mt Seymour a délivré un abonnement pour la saison 2023/2024, qui a ensuite été résilié pour quelque raison que ce soit; et
• (f) Les personnes qui ne sont autrement pas autorisées à participer à XPLR Pass (y compris les revendeurs non autorisés d’articles The North Face). 

La participation constitue la totalité de l’accord inconditionnel du participant à ce règlement officiel et aux décisions du Commanditaire ou de l’Administrateur, qui sont définitives et contraignantes pour toutes les questions liées au Concours. Pour gagner un prix, il est impératif de remplir toutes les conditions énoncées dans le présent document.

Le Concours débute le vendredi 15 décembre 2023 à 0h00 (heure du Pacifique) et prend fin le samedi 6 janvier 2024 à 23h59 (heure du Pacifique) (la « Période de promotion »). L’ordinateur d’AnyRoad Inc. est l’horloge officielle de cette Promotion.
 

5. Comment participer

Pour participer au Concours, naviguez jusqu’à https://www.thenorthface.com/en-ca/events#id=canada-mtn-mix-sweepstakes (le « site Web ») pendant la Période de promotion. Sur ce site, vous devez remplir le formulaire de participation en indiquant vos nom, prénom, adresse courriel, code postal, date de naissance (facultatif), numéro de téléphone portable, et confirmer que vous êtes un membre du XPLR Pass et que vous avez un abonnement pour Mt Seymour pour la saison 2023-2024.

Il pourra vous être demandé d’accepter de recevoir des courriels promotionnels et de rappel de la part du Commanditaire. Accepter de recevoir des courriels promotionnels et/ou de rappel est facultatif, n’est nullement obligatoire pour adhérer à XPLR Pass ou pouvoir participer au Concours et n’améliore pas vos chances de gagner. Si vous acceptez de recevoir ces courriels, l’adresse fournie sera soumise à la politique de confidentialité du Commanditaire et vous pourrez vous désabonner à n’importe quel moment.

Pour soumettre votre participation (« Participation »), cliquez sur le bouton « Submit » (Soumettre) sur le site Web. La preuve de la saisie d’informations sur le site Web n’est pas considérée comme une preuve de remise des informations ou de leur réception par le Commanditaire ou l’Administrateur. La réception d’une participation peut faire l’objet d’un accusé de réception, mais celui-ci ne constitue nullement une déclaration du Commanditaire ou de l’Administrateur quant à l’admissibilité de la participation et ne les lie d’aucune autre façon.

La participation au moyen d’un appareil mobile peut entraîner des frais pour la transmission de messages et de données. Assurez-vous de vérifier le plan tarifaire de votre opérateur sans fil avant de participer. L’accès à l’Internet sans fil peut ne pas être disponible dans toutes les régions.
 

6. Restrictions supplémentaires sur la participation

Limite d’une (1) participation par personne. Les participations multiples envoyées par une seule personne en violation de la limite indiquée précédemment annuleront toutes ces participations et peuvent entraîner la révocation de l’adhésion à XPLR Pass. Les participations générées par un script, une macro ou tout autre moyen automatisé ou moyen permettant d’éluder le processus de participation seront disqualifiées (et pourront entraîner la révocation de l’adhésion à XPLR Pass). Les participations tardives, perdues, incomplètes, tronquées, illisibles, retardées, endommagées, corrompues, confuses, égarées, mal enregistrées (ou pas enregistrées du tout) ou inintelligibles pour quelque raison que ce soit, y compris, sans toutefois s’y limiter, un dysfonctionnement ou une congestion de l’appareil mobile ou du réseau, sont nulles et ne seront pas acceptées.
 

7. Tirage au sort et chances de remporter un prix

Deux (2) gagnants seront tirés au sort le 8 janvier 2024, ou aux alentours de cette date, par l’Administrateur, à l’adresse indiquée ci-dessus ou à tout autre endroit que pourra choisir le Commanditaire. Deux (2) tirages au sort séparés et distincts auront lieu. Les participations pour un [1] tirage au sort ne seront pas conservées pour le deuxième tirage au sort. Un (1) gagnant sera sélectionné par tirage au sort parmi toutes les participations admissibles reçues des détenteurs d’un abonnement au Mt Seymour pour la saison 2023/2024 (en plus d’être membres de XPLR Pass) et un (1) gagnant sera sélectionné par tirage au sort parmi toutes les participations admissibles reçues des membres de XPLR Pass qui n’ont pas d’abonnement au Mt Seymour pour la saison 2023/2024. Les décisions de l’Administrateur sont définitives et contraignantes pour toutes les questions liées au Concours.

Les chances de gagner dépendent du nombre total de participations admissibles reçues pour le tirage au sort applicable.
 

8. Notification des gagnants et vérification

Chaque gagnant potentiel du premier prix sera contacté par téléphone le 8 janvier 2024 ou aux alentours de cette date. Pour qu’il puisse rester admissible au Concours, le gagnant potentiel doit encore être membre de XPLR Pass au moment de la notification et, le cas échéant, il doit encore avoir un abonnement au Mt Seymour pour la saison 2023/2024 au moment de la notification. Si un gagnant potentiel ne répond pas à la première tentative d’appel téléphonique de l’Administrateur (et peut-être la seule) ou s’il ne rappelle pas dans les vingt-quatre (24) heures qui suivent, il sera disqualifié sans compensation d’aucune sorte (pour éviter toute ambiguïté, il ne sera pas laissé de message si le gagnant potentiel ne peut pas être joint) et un autre gagnant potentiel pourra être sélectionné et contacté, si les délais le permettent. Pour être considéré comme gagnant, les participants sélectionnés devront d’abord répondre correctement à une question d’arithmétique temporelle, sans aucune aide, qui sera établie par l’Administrateur. Lorsque l’admissibilité, l’intérêt et la disponibilité du gagnant potentiel auront été confirmés par téléphone, il devra, dans les soixante-douze (72) heures suivant la notification (ou dans un délai plus court si la notification l’indique), signer et renvoyer une attestation d’admissibilité, de décharge et d’indemnisation, une décharge de publicité lorsque la loi l’autorise et une décharge pour invité(e) (collectivement désignés les « Documents de réclamation du prix »). Le gagnant potentiel qui a déjà un abonnement au Mt Seymour doit également fournir le numéro d’identification à 14 chiffres de son abonnement en cours et valide pour la saison 2023-2024 à des fins de vérification. Si les Documents de réclamation du prix (autres que la décharge pour invité(e))† ne sont pas renvoyés à l’Administrateur dans les délais précisés ou si une notification de prix ou un prix est renvoyé car il n’a pas pu être livré, ou si un gagnant potentiel s’avère être inéligible ou ne respecte pas le présent règlement officiel, ou s’il refuse le prix pour une raison quelconque avant son attribution, le prix peut être annulé et le gagnant potentiel disqualifié et un autre gagnant peut être sélectionné parmi toutes les participations admissibles restantes reçues pendant la période de promotion pour le tirage au sort applicable (si les délais le permettent). Les documents de réclamation du prix s’ajoutent aux renonciations et décharges qui peuvent être exigées par Mt Seymour dans le cadre de la participation à l’événement par le gagnant du premier prix et son invité(e).

†Si tous les documents de réclamation du prix autres que la décharge pour invité(e) sont renvoyés dans les délais, le gagnant du premier prix pourra recevoir le prix pour lui seul (c’est-à-dire sans invité(e)) et aucun(e) autre prix ou compensation ne sera attribué(e). 

En cas de litige concernant l’identité d’un participant, la participation sera considérée comme ayant été soumise par la personne physique qui est le titulaire autorisé du compte courriel utilisé pour la transmission et associé au programme XPLR Pass de The North Face. (Pour pouvoir participer au tirage au sort de l’abonnement saisonnier au Mt Seymour, cette personne doit également être le détenteur autorisé de l’abonnement.)  Le « titulaire autorisé du compte » est défini comme la personne physique à qui une adresse électronique est attribuée par un fournisseur d’accès à Internet, un fournisseur de services en ligne ou une autre organisation (par exemple, une entreprise, un établissement d’enseignement, etc.) chargé(e) d’attribuer des adresses électroniques pour le domaine associé à l’adresse électronique soumise. 
 

9. Prix et valeur approximative de vente au détail

Premier prix (deux [2] gagnants) : Chaque gagnant du premier prix bénéficiera d’une expérience de camping de 2 jours et 1 nuit pour deux (2) personnes au sommet du Mt Seymour à North Vancouver (Canada) le samedi 3 février et dimanche 4 février 2024 (« l’Événement »). LE VOYAGE JUSQU’À L’ÉVÉNEMENT AU MT SEYMOUR À NORTH VANCOUVER (CANADA) N’EST PAS INCLUS. Les gagnants du premier prix et leurs invités doivent participer à l’événement les 3 et 4 février 2024. Si un gagnant du premier prix ne peut y participer pour quelque raison que ce soit, le prix sera annulé sans compensation d’aucune sorte et un autre gagnant pourra être sélectionné conformément à la section 8. L’expérience de camping d’hiver comprend une (1) location de tente 4-seasons The North Face pour deux (2) personnes, deux (2) locations de sacs de couchage -20 The North Face, une (1) location de matelas The North Face pour deux (2) personnes, des billets de remontée mécanique pour deux (2) jours de glisse (3 et 4 février 2024) (disponible uniquement si un gagnant ou un(e) invité(e) n’a pas d’abonnement au Mt Seymour pour la saison 2023-2024. Si le gagnant ou l’invité(e) a son propre abonnement au Mt Seymour pour la saison 2023-2024, aucun(e) prix de substitution ou compensation ne sera attribué(e) à la place des billets de remontées mécaniques. Ce qui précède inclut, sans toutefois être limité au gagnant du tirage au sort pour l’abonnement saisonnier au Mt Seymour, le dîner et le petit déjeuner au camping (à l’exclusion de boissons alcoolisées; le Commanditaire décline toute responsabilité en cas d’incapacité à répondre aux restrictions alimentaires des gagnants et de leurs invités; des restrictions additionnelles peuvent s’appliquer), et un ensemble de produits The North Face pour le gagnant et son invité(e) comprenant une veste Summit Breithorn de The North Face, des mitaines de ski Montana de The North Face, un sac Basecamp de The North Face (taille L) et un bonnet doublé Salty de The North Face. Le style, la couleur et la taille des articles (le cas échéant) sont soumis à disponibilité. La tente, les sacs de couchage et le matelas de location seront installés à l’arrivée des gagnants et de leurs invités par un représentant du Commanditaire. Pour éviter toute ambiguïté, les gagnants et leurs invités NE PEUVENT PAS remporter ces articles avec eux à la fin de l’événement et assumeront la responsabilité pour tout dommage causé à la tente, aux sacs de couchage ou au matelas au-delà de l’usure normale avec une utilisation conforme aux directives. Valeur approximative de vente au détail de chaque premier prix : 3 000,00 $CAD. Voir les restrictions ou conditions supplémentaires ci-dessous.

L’événement a lieu, qu’il pleuve, qu’il neige ou qu’il fasse beau. En cas de mauvais temps pour un des jours ou les deux (tel que le Commanditaire ou le fournisseur du prix pourra le déterminer à sa seule discrétion), les gagnants pourront être logés à l’intérieur (au lieu d’une expérience de camping), sans compensation supplémentaire ni prix de remplacement. 

Du matériel de ski et/ou de snowboard (le « Matériel ») n’est pas requis dans le cadre de l’événement ni inclus dans le premier prix. Si un gagnant ou un(e) invité(e) souhaite louer du matériel, la location sera effectuée aux frais du gagnant et sous réserve de disponibilité et de restrictions. Une liste d’articles suggérés sera fournie aux gagnants du premier prix avant la date de l’événement. Les gagnants du premier prix et leurs invités devront obligatoirement s’enregistrer le 3 février 2024 pour effectuer une vérification du matériel à des fins de sécurité et signer des exonérations supplémentaires fournies par le Commanditaire et éventuellement par Mt Seymour. Si un gagnant du premier prix ou son invité(e) ne passe pas le contrôle du matériel, le gagnant et/ou son invité(e) (le cas échéant) risque(nt) de ne pas être autorisé(es) à participer à l’événement (à la seule discrétion du Commanditaire). Les gagnants du premier prix et leurs invités peuvent avoir la possibilité d’acheter des articles à leur arrivée, mais ceux-ci sont soumis à disponibilité et ne sont pas garantis par le Commanditaire. Si ce dernier décide qu’un gagnant du premier prix ou son invité(e) n’est pas préparé(e) et n’est donc pas autorisé(e) à participer à l’événement, le prix sera annulé sans compensation d’aucune sorte.

L’invité(e) du gagnant du premier prix doit être âgé(e) d’au moins dix-neuf (19) ans et doit remplir, signer et renvoyer une décharge de responsabilité et une décharge de publicité (si la loi l’autorise) avant l’événement. Si un gagnant du premier prix choisit de participer à l’événement sans être accompagné d’un(e) invité(e) (ou si l’invité(e) ne renvoie pas la décharge signée en temps voulu comme indiqué à la section 8), le prix sera attribué par tranches appropriées pour une seule personne (c’est-à-dire le gagnant lui-même) et aucun(e) autre prix ou compensation ne sera attribué(e).

Les gagnants du premier prix et leurs invités comprennent et acceptent que le camping d’hiver en plein air et les activités associées (y compris, sans toutefois s’y limiter, le ski ou le snowboard) comportent certains risques et dangers inhérents qui peuvent entraîner des blessures ou la mort, même avec la participation d’un instructeur ou d’un guide (le cas échéant) et en suivant tous les protocoles de sécurité appropriés. SANS S’Y LIMITER, LES GAGNANTS DU PREMIER PRIX ET LEURS INVITÉS RECONNAISSENT EXPRESSÉMENT QUE LES TEMPÉRATURES À NORTH VANCOUVER (CANADA) AU DÉBUT DU MOIS DE FÉVRIER SONT GÉNÉRALEMENT GLACIALES (C’EST-À-DIRE INFÉRIEURES À 0 DEGRÉ CELSIUS) ET QUE CES TEMPÉRATURES PEUVENT PARAÎTRE ENCORE PLUS FROIDES EN RAISON DU VENT AU SOMMET DU MT SEYMOUR. À titre d’exemple seulement, ces risques comprennent les glissades et les chutes causées par la glace, un sol inégal ou autre, des efforts physiques très importants, une déshydratation, une hypothermie et l’exposition à des tempêtes soudaines ou à d’autres changements inattendus des conditions météorologiques. IL EST CONSEILLÉ DE NE PAS PARTICIPER AU CONCOURS SI VOUS NE SOUHAITEZ PAS ACCEPTER DE TELS RISQUES AU CAS OÙ VOTRE PARTICIPATION SERAIT SÉLECTIONNÉE ET QUE VOUS SERIEZ CONFIRMÉ COMME ÉTANT LE GAGNANT DU PRIX.

Il faut avoir un certain niveau de santé et de forme physique pour participer au camping d’hiver en plein air et aux activités associées (y compris le ski et le snowboard). NE PARTICIPEZ PAS AU CONCOURS SI VOUS N’ÊTES PAS RAISONNABLEMENT CONVAINCU DE POUVOIR PRATIQUER LE CAMPING D’HIVER EN PLEIN AIR ET LES ACTIVITÉS ASSOCIÉES (Y COMPRIS, SANS TOUTEFOIS S’Y LIMITER, LE SKI OU LE SNOWBOARD) AU CAS OÙ VOTRE PARTICIPATION SERAIT SÉLECTIONNÉE ET QUE VOUS SERIEZ CONFIRMÉ COMME ÉTANT LE GAGNANT DU PRIX. 

Les gagnants du premier prix et leurs invités doivent suivre toutes les instructions du Commanditaire et du fournisseur du prix et ils sont tenus de se conformer à toutes les politiques du Mt Seymour. Ne pas respecter cette obligation pourrait entraîner l’annulation du prix. Si un gagnant du premier prix et/ou son invité(e) ne respecte(nt) pas ces instructions ou adopte(nt) un comportement incontrôlé, désagréable, illégal, menaçant ou autrement inapproprié (comme le Commanditaire et/ou le fournisseur du prix pourront le déterminer à leur seule discrétion), le Commanditaire se réserve le droit, sans autre avis ou avertissement, de mettre fin à la participation du gagnant et/ou de son invité(e) à l’événement et/ou de prendre d’autres mesures qu’il juge appropriées à sa seule discrétion, sans aucune responsabilité ou autre obligation envers le gagnant du premier prix ou son invité(e). (Ce qui précède vient s’ajouter à toutes les mesures que pourrait prendre le fournisseur du prix). Un comportement inapproprié comprend, sans toutefois s’y limiter, le non-respect des politiques du fournisseur du prix (par exemple, skier ou faire du snowboard de manière imprudente) ainsi que le non-respect par un gagnant du premier prix ou un(e) invité(e) des règles gouvernementales, du fournisseur du prix ou d’autres exigences de tiers visant à prévenir la propagation de la COVID-19 (par exemple, le port d’un masque, la distanciation ou remplir un questionnaire de santé). 

Il est à noter que les politiques du Commanditaire ou du fournisseur du prix ou d’autres fournisseurs de prix, les directives du CDC et les recommandations des autorités sanitaires doivent être respectées. Il faut aussi noter que tout lieu public fréquenté présente un risque inhérent d’exposition à la COVID-19, et que le Commanditaire ne peut nullement garantir qu’aucune personne n’y sera exposée au cours de l’événement. En outre, la pratique du camping et des activités liées à l’événement à proximité d’autres personnes pourrait accroître ces risques sanitaires.

Limite d’un (1) prix par personne, par famille ou par foyer. Tous les détails concernant le premier prix seront définis à la seule discrétion du Commanditaire. Ce dernier se réserve le droit de remplacer le premier prix (ou une partie du prix, le cas échéant) par un prix similaire (ou un élément le composant, le cas échéant) de valeur comparable ou supérieure. Certaines activités comprises dans l’événement peuvent être soumises à des disponibilités et/ou à d’autres restrictions. Toutes les autres dépenses, les coûts ou les frais associés à l’acceptation et/ou à l’utilisation du premier prix sont à la charge exclusive des gagnants. Cela comprend notamment le voyage jusqu’à destination et le retour de North Vancouver pour l’événement, ainsi que toute assurance vie ou autre souhaitée dans le cadre de celui-ci. Le premier prix ne peut être transféré par un gagnant ou échangé contre de l’argent et n’est valable que pour l’expérience que propose l’événement, telle que décrite ci-dessus, sans possibilité de substitution du premier prix par un gagnant. Les images publicitaires des lieux et/ou des activités qui composent le premier prix sont fournies à titre d’illustration seulement et les éléments réels qui composent le premier prix peuvent différer de ces images pour diverses raisons. Le Commanditaire et l’Administrateur (ainsi que le fournisseur du prix) déclinent toute responsabilité à cet égard. 

LA SEULE GARANTIE SUR LE PRIX EST LA GARANTIE EXPRESSE DU COMMANDITAIRE SUR SES PROPRES PRODUITS, QUI EST LIMITÉE À SES CONDITIONS; DANS TOUTE LA MESURE PERMISE PAR LA LOI, LE COMMANDITAIRE NE FOURNIT AUCUNE AUTRE GARANTIE, REPRÉSENTATION OU DÉCLARATION DE QUELQUE NATURE QUE CE SOIT CONCERNANT UN ÉLÉMENT QUELCONQUE DU PRIX. 
 

10. Conditions de participation et décharge

En s’inscrivant, chaque participant décharge et accepte de dégager de toute responsabilité le Commanditaire, l’Administrateur, Mt Seymour, AnyRoad Inc., Dizzle Entertainment Inc., Meta Platforms, Inc., chacune de leurs sociétés mères, divisions, filiales et sociétés affiliées respectives, ainsi que l’ensemble de leurs dirigeants, administrateurs, employés, agents, actionnaires et représentants respectifs (collectivement désignés les « Parties exonérées ») pour toute réclamation, dépense et responsabilité, y compris, sans toutefois s’y limiter, la négligence, les dommages ou les blessures de toute nature aux personnes et aux biens, y compris, sans toutefois s’y limiter, l’atteinte à la vie privée (dans le cadre d’une appropriation, intrusion, divulgation publique de faits privés, représentation sous un mauvais jour ou autre théorie juridique), diffamation, médisance, calomnie, violation du droit de publicité, violation de la marque, du droit d’auteur ou d’autres droits de propriété intellectuelle, dommages matériels, décès ou blessures corporelles découlant de l’inscription d’un participant, la participation à la Promotion, l’acceptation ou l’utilisation ou la mauvaise utilisation du prix (le cas échéant) ou y étant liés; et (c) indemniser, défendre et dégager de toute responsabilité les parties exonérées de toute réclamation, dépense et responsabilité (y compris les honoraires d’avocat raisonnables) découlant de la participation à la Promotion et/ou de l’acceptation, de l’utilisation ou de la mauvaise utilisation du prix (le cas échéant). En s’inscrivant à la Promotion, le participant accepte (i) que tous les litiges, les réclamations et les causes d’action découlant de la Promotion ou de l’attribution du prix ou y étant liés soient résolus individuellement, sans recours à aucune forme de recours collectif; (ii) que toutes les réclamations, tous les jugements et toutes les sentences soient limités aux frais réels encourus, y compris les frais associés à la participation à la Promotion (le cas échéant), mais en aucun cas aux honoraires d’avocat; et (iii) qu’en aucun cas un participant ne sera autorisé à obtenir une indemnité pour des dommages exemplaires, accessoires ou consécutifs ni aucun autre droit de faire multiplier ou augmenter les dommages, autre que les dommages pour les dépenses réelles (le cas échéant) ainsi que la renonciation à tout droit à un redressement équitable, et le participant renonce par la présente à une telle réclamation.
 

11. Publicité

Sauf en cas d’interdiction, l’acceptation du prix constitue le consentement du gagnant à l’utilisation par le Commanditaire et ses représentants (y compris le fournisseur du prix) du nom, de la ressemblance, de la photographie, de la voix, des avis et/ou de la ville d’origine du gagnant à des fins promotionnelles dans tout média, dans le monde entier, sans autre forme de paiement ou de rémunération ou examen ou approbation de quelque nature que ce soit.
 

12. Conditions générales

Le Commanditaire se réserve le droit d’annuler, de suspendre et/ou de modifier le Concours ou toute partie de celui-ci, en cas de fraude, de défaillance technique, de pandémie/épidémie, de pénurie de matériel, de troubles civils, d’émeute, de grève, de catastrophe naturelle de quelque nature que ce soit ou de tout autre facteur indépendant de sa volonté, compromettant l’intégrité ou le bon déroulement du Concours, tel que le Commanditaire ou l’Administrateur peut le déterminer à sa seule discrétion. Dans ce cas, le Commanditaire s’efforcera dans la mesure du possible de proposer le Concours et de sélectionner le gagnant pour chaque tirage au sort concerné à partir de toutes les participations admissibles reçues pour ledit tirage au sort avant et/ou après la mesure prise par le Commanditaire (selon ce qui peut être approprié) ou d’une autre manière que le Commanditaire ou l’Administrateur juge, à sa seule discrétion, équitable, appropriée et conforme au présent règlement officiel. La notification d’une telle action par le Commanditaire sera affichée sur le site Web. Le Commanditaire se réserve le droit, à sa seule discrétion, de disqualifier toute personne que le Commanditaire et/ou l’Administrateur découvrent en train de falsifier la procédure de participation au Concours ou son fonctionnement, qui cherche à escroquer le Commanditaire et/ou l’Administrateur concernant l’adhésion à XPLR Pass et/ou l’abonnement au Mt Seymour pour la saison 2023/2024 ou qui agit en violation de ce règlement officiel ou de manière antisportive, belliqueuse, antisociale ou préjudiciable. Le fait que le Commanditaire ou l’Administrateur n’applique pas une disposition du présent règlement officiel dans une circonstance donnée ne constitue nullement une renonciation à cette disposition.
 

13. Limitations de responsabilité

Les parties exonérées ne sont nullement responsables (a) de toute information incorrecte ou inexacte, qu’elle ait pour origine les participants ou la programmation associée à la Promotion ou qu’elle soit utilisée dans le cadre de celle-ci; (b) des défaillances techniques de quelque nature que ce soit, y compris, sans toutefois s’y limiter, les dysfonctionnements, les interruptions ou les déconnexions des lignes téléphoniques ou du matériel ou des logiciels de réseau; (c) de l’intervention humaine non autorisée dans toute partie du Concours, y compris, sans toutefois s’y limiter, l’utilisation du site Web; (d) d’une erreur technique ou humaine, qui peut survenir dans l’administration du Concours ou le traitement des adhésions à XPLR Pass et/ou des participations au Concours; ou (e) de tout(e) blessure ou dommage aux personnes ou aux biens, qui peut être causé(e), directement ou indirectement, en tout ou en partie, par la participation au Concours ou par la réception ou l’utilisation ou la mauvaise utilisation du prix (le cas échéant). 

Si, pour quelque raison que ce soit, il est confirmé que la participation d’un participant a été supprimée par erreur, perdue ou détruite ou corrompue de toute autre façon, le seul recours du participant est une autre participation au Concours dans la mesure du possible. Si ce n’est cependant pas possible, les parties exonérées n’auront aucune responsabilité, quelle qu’elle soit. Seul le nombre de prix indiqué sera attribué (c’est-à-dire deux [2] prix).
 

14. Litiges; choix de la loi applicable

Sauf en cas d’interdiction, les participants acceptent que tous les litiges, réclamations et causes d’action découlant de ce Concours ou de l’attribution des prix ou détermination des gagnants, ou y étant liés, soient résolus conformément au droit matériel interne de l’Ontario (c’est-à-dire sans tenir compte du choix de la loi applicable ou des règles de conflit de lois de l’Ontario ou de toute autre juridiction), devant les tribunaux de l’Ontario, et vous acceptez la compétence personnelle et exclusive de ces tribunaux et renoncez à tout droit de changement de lieu, de forum inapproprié ou autre.

Si la disposition précédente ou toute autre disposition du présent règlement officiel est jugée invalide, illégale ou inapplicable par un tribunal compétent, elle sera substituée par une disposition de remplacement qui se rapproche le plus possible de l’intention initiale du Commanditaire et qui est valide, légale et applicable. La nullité, l’illégalité ou l’inapplicabilité d’une disposition donnée n’affectera nullement le reste du présent règlement officiel.
 

15. Informations personnelles du participant

En participant au Concours, vous consentez à la collecte, à l’utilisation et à la divulgation de vos informations personnelles dans le but d’administrer ce Concours, y compris la remise des prix (le cas échéant) et l’inscription au programme XPLR Pass. En outre, vous comprenez et acceptez que vos informations personnelles puissent être transmises aux États-Unis, où les protections et les droits des consommateurs en matière d’informations personnelles sont plus limités qu’au Canada. Il vous est vivement conseillé de consulter la politique de confidentialité de The North Face, accessible sur https://www.thenorthface.com/fr-ca/help/privacy), AVANT de participer au Concours (et, le cas échéant, de vous inscrire à XPLR Pass). 
 

16. Liste des gagnants

Pour obtenir les noms des gagnants, envoyez une enveloppe timbrée, adressée à votre nom, à The North Face MTN MIX Winners- Canada, c/o Probability, PO Box 1559, Social Circle, GA 30025-1559. Toutes ces demandes doivent être reçues avant le 26 janvier 2024.
